These Terms and Conditions set out the basis on which Rubbish Removal Wandsworth provides waste collection and related services to you. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 "Company" means Rubbish Removal Wandsworth, the waste collection service provider.
1.2 "Customer" or "you" means the individual, business, landlord, tenant, contractor or other entity that books or uses the services.
1.3 "Services" means rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling and any related services provided by the Company.
1.4 "Site" means the premises, property or location where the Services are to be carried out.
1.5 "Waste" means the items, materials, rubbish, household waste, commercial waste or other discardable items that are to be collected under the booking, excluding any prohibited waste.
1.6 "Prohibited Waste" means waste that the Company is not permitted or willing to collect, including but not limited to hazardous, medical, chemical, liquid, pressurised, explosive, asbestos-containing or otherwise restricted materials under applicable law.
2. Scope of Services
2.1 The Company provides on-demand rubbish removal and waste collection services for domestic, commercial and construction customers. Services may include collection of bagged waste, bulky items, garden waste, light construction debris and similar materials, subject to assessment.
2.2 The specific scope of each job, including the estimated volume, type of Waste, access arrangements, timings and price, will be confirmed during the booking process based on information provided by the Customer.
2.3 The Company reserves the right to refuse or amend a booking if the actual Waste, access conditions or Site circumstances differ materially from those described by the Customer at the time of booking.
3. Booking Process
3.1 Bookings can be made by telephone, email or other communication methods made available by the Company from time to time.
3.2 When placing a booking, the Customer must provide accurate and complete information, including:
(a) Full name and contact details.
(b) Service address and any access restrictions.
(c) Description and approximate quantity or volume of the Waste.
(d) Preferred date and time window for collection.
3.3 Any quotation given at the time of booking is based on the information supplied by the Customer. The Company may adjust the price on arrival if the Waste volume, type or access conditions differ from the description provided.
3.4 A booking is only confirmed when the Company has accepted it and communicated confirmation to the Customer. The Company may decline any booking at its sole discretion.
3.5 The Customer must ensure that someone authorised is present on Site at the agreed time to grant access, confirm the scope of Waste and approve any variations to the agreed price.
4. Pricing and Quotations
4.1 Prices are generally based on the volume and type of Waste collected, the time required on Site, the labour involved and any additional services requested.
4.2 Any quotation provided prior to attendance is an estimate only, subject to visual inspection of the Waste and Site by the Company upon arrival.
4.3 If the price needs to be adjusted based on the actual circumstances, the Company will explain the revised price before commencing the work. If the Customer does not agree to the revised price, the Company reserves the right not to proceed with the Service and may charge a call-out or cancellation fee in accordance with these terms.
4.4 All prices are stated in pounds sterling and may be inclusive or exclusive of VAT depending on the Company's VAT status, which will be explained to the Customer.
5. Payments
5.1 Payment is due on completion of the Service, unless otherwise agreed in writing. For some bookings, partial or full prepayment may be required to secure the appointment.
5.2 The Company accepts commonly used payment methods such as cash, debit or credit card and bank transfer, subject to availability and any conditions communicated at the time of booking.
5.3 Where payment is not made on Site, the Customer remains responsible for ensuring full payment is received by the Company within the agreed timeframe.
5.4 Invoices for business Customers may be issued on completion of the Service or at agreed intervals. Payment terms will be stated on the invoice. Late payment may incur interest and reasonable recovery costs as permitted under applicable law.
5.5 The Company reserves the right to suspend or cancel further Services for any Customer who fails to pay on time.
6. Cancellations and Rescheduling
6.1 The Customer may cancel or reschedule a booking by contacting the Company with reasonable notice prior to the agreed arrival time.
6.2 Where the Customer cancels or reschedules with at least 24 hours' notice, any paid deposit may be refundable or transferable at the Company's discretion, subject to any specific arrangements agreed at the time of booking.
6.3 If the Customer cancels or reschedules with less than 24 hours' notice, or fails to provide access on arrival, the Company may charge a reasonable cancellation or call-out fee to cover time, travel and administrative costs.
6.4 If the Company is unable to attend a confirmed booking due to operational issues, traffic conditions, staff illness or other factors beyond its reasonable control, it will use reasonable efforts to inform the Customer and arrange an alternative appointment. The Company will not be liable for any indirect loss or costs arising from such changes.
7. Customer Responsibilities
7.1 The Customer must ensure safe, clear and lawful access to the Site and to the Waste to be removed. This includes providing any necessary permissions to enter shared areas, driveways, car parks or communal spaces.
7.2 The Customer must ensure that the Waste is reasonably accessible and, where agreed, bagged or grouped to facilitate efficient loading.
7.3 The Customer must not include Prohibited Waste within the Waste presented for collection. If such materials are discovered, the Company may refuse to collect them, adjust the price, or terminate the Service.
7.4 The Customer is responsible for securing any necessary consents from property owners, neighbours, managing agents or local authorities for the collection and removal of Waste from the Site.
7.5 The Customer must ensure that children, pets and uninvolved persons are kept at a safe distance from the working area while the Services are carried out.
8. Waste Regulations and Duty of Care
8.1 The Company operates in accordance with applicable UK waste management laws and regulations. Waste collected will be transported to authorised facilities for disposal or recycling as appropriate.
8.2 The Customer acknowledges their legal duty of care in relation to Waste and must provide accurate information about the nature of the Waste. Misrepresentation of Waste type or contamination of loads may result in additional charges or refusal of Service.
8.3 Where required, the Company will provide a waste transfer note or similar documentation to confirm the lawful transfer of control of the Waste from the Customer to the Company.
8.4 The Company aims to maximise reuse and recycling where practicable. However, no guarantee is given that any particular item will be recycled or reused.
9. Prohibited and Hazardous Waste
9.1 The Company does not normally collect hazardous or specialist wastes, including but not limited to:
(a) Asbestos and asbestos-containing materials.
(b) Chemicals, solvents, paints and oils, unless specifically agreed.
(c) Clinical or medical waste, syringes or sharps.
(d) Gas bottles, cylinders, explosives or pressurised containers.
(e) Large quantities of liquid waste.
9.2 If such items are discovered within a load, the Company may at its discretion:
(a) Refuse to collect the items.
(b) Adjust the quoted price to reflect additional handling and disposal costs.
(c) Terminate the Service and charge for time and costs incurred.
9.3 The Customer is responsible for arranging safe and lawful disposal of any Prohibited Waste through appropriate specialist channels.
10. Liability and Limitations
10.1 The Company will exercise reasonable care and skill in providing the Services. However, it will not be liable for any loss or damage arising from inaccurate information provided by the Customer or from circumstances beyond its reasonable control.
10.2 The Company will not be responsible for pre-existing damage to property, fixtures, fittings or surfaces. Customers are advised to notify the team of any fragile structures, delicate surfaces or vulnerable items in the working area.
10.3 Where the Company is requested to carry Waste through buildings, narrow access routes, across lawns or over surfaces that are not ideally suited for such movement, the Customer accepts that some minor scuffs, marks or disturbance may be unavoidable. The Company will use reasonable care but accepts no liability for cosmetic damage in such circumstances.
10.4 The Company shall not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of opportunity or similar economic loss arising in connection with the Services.
10.5 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be excluded under applicable law.
11. Access, Parking and Permits
11.1 The Customer must ensure that suitable parking or stopping space is available for the Company's vehicle as close as reasonably practicable to the Site. If parking restrictions apply, the Customer is responsible for arranging permits or cover any associated costs, unless expressly agreed otherwise.
11.2 Where parking charges, penalty charge notices or similar costs are incurred due to inaccurate information or failure by the Customer to arrange suitable access, the Company may pass such costs on to the Customer.
11.3 If adequate access or parking cannot be secured on arrival, the Company may be unable to carry out the Service and may apply a cancellation or call-out fee.
12. Ownership of Waste and Title
12.1 Ownership and responsibility for the Waste passes from the Customer to the Company at the point at which the Waste is loaded onto the Company's vehicle.
12.2 Prior to loading, the Customer must ensure that no items intended to be retained, stored or used are left within or adjacent to the Waste to be removed. The Company cannot accept responsibility for items taken in error where it was reasonable to assume they formed part of the Waste.
13. Complaints and Disputes
13.1 If you are dissatisfied with any aspect of the Service, you should contact the Company as soon as possible, providing details of the issue and any supporting evidence.
13.2 The Company will investigate complaints in a fair and timely manner and will aim to provide a response or proposed resolution within a reasonable period.
13.3 Any dispute relating to invoices, charges or service quality should be raised within 14 days of the Service date or invoice date, whichever is later. The Company reserves the right to reject complaints made outside this period where it is no longer practicable to investigate.
14. Data Protection and Privacy
14.1 The Company may collect and process personal data such as names, contact details and service addresses for the purpose of administering bookings, providing Services, handling payments and managing customer relationships.
14.2 Personal information will be handled in accordance with applicable data protection laws. The Company will take reasonable steps to protect such data against unauthorised access, misuse or loss.
14.3 The Customer consents to the Company contacting them by phone, email or other suitable means in relation to bookings, confirmations, updates, invoices and service-related communications.
15. Amendments to Terms
15.1 The Company may update or amend these Terms and Conditions from time to time. Any revised terms will apply to new bookings made after the date of publication of the updated version.
15.2 For ongoing or contract-based arrangements, the Company will notify the Customer of any material changes to the Terms and Conditions. Continued use of the Services after such notification will be taken as acceptance of the revised terms.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
17. General Provisions
17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
17.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
17.3 These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior understandings, representations or agreements, whether oral or written.
17.4 The Customer may not assign or transfer their rights or obligations under these Terms and Conditions without the Company's prior written consent. The Company may assign or subcontract its rights and obligations where reasonably necessary for the performance of the Services.
